General conditions regarding the use of “Subscribers Register” service offered by Infoclick SA

1. Scope of Service

1.1. INFOCLICK SA (the "Company") provides information service on subscribers in accordance with the legislation in telecommunications, consumer protection and privacy. The Company provides the user ("Customer") access to services through number 118800 by means of interconnection agreements concluded with other providers of telecommunications.
1.2. The contract between the Company and Client is established whenever a Client calls the number 118800 and the connection is successful, and lasts only for the corresponding call.
1.3. Currently, by calling 118800 the following information may be obtained:
• phone connection with a geographical number in Romania.
• prefix information for geographic areas in Romania.
(hereinafter denominated “Service” or “Services”)

2. Provision of service

2.1. The company provides this information by means of specialized operators or IVR system where possible technically and operationally.
2.2. The service can be offered only when relevant data is available. The company reserves the right to modify, suspend or activate a certain Service at any time.

3. Connection service to the required number (Call-completion)

After announcing the research results, the Company may, at the Client’s request, complete the call at the requested phone number, provided such possibility exist, technically and operationally. Moreover, the Client may be connected to other telephone information services in order to obtain information from other available sources, but the Company cannot control or guarantee the completeness or accuracy of such information.

4. Invoicing service

4.1. The Client is charged at the rate applied to the Service by the telephony provider on whose network is subscribed when calling the Service. The Price list can be modified at any time, in accordance with the applicable legislation in telecommunications, consumer law, and ANCOM decisions. The Company is not responsible for any charges imposed by telephony suppliers.
4.2. The prices applicable to the Service, depending on the network in which the Service is called, are as follows:

5. Payment conditions

5.1. The Client will pay the Services used, calculated according to art. 4.1 above, on the terms agreed in the contract signed with the telephone services provider in whose network is subscribed.
5.2. The Client's payment obligation is maintained in the case when, while using the service of direct connection to the requested number, for transfer to the third party, the connection cannot be achieved due to lack of accuracy of existing data or technical or operational malfunctions in the called party’s network.

6. Suspension/ Restriction of Service delivery

The Company may restrict or suspend the Client's access to the Services immediately, without notice or other formality and with no right to compensation in the following situations: a) client’s illegal use of Service, b) the client put in danger the network by using a damaged terminal equipment or by other means, c) in case the amounts owed by the Client to the telephony provider to which is subscribed, have increased substantially and considering the incidence of previously unpaid debts it is likely for present debts not to be paid.

7. Objections

All Client’s complaints in respect to the invoiced amount shall be submitted to the provider with whom they signed the contract for telephony services provision. These will be settled according to the procedures agreed in the contracts above mentioned.

8. Company’s liability

8.1. The company is not responsible towards the Client for any financial loss suffered as a result of using the Service.
8.2. For events of force majeure, preventing the provision of service, the Company has the right to suspend the service during the event of force majeure, including any reasonable period necessary for resumption of activity.
8.3. The company is not responsible for the availability of information and the accuracy of information supplied by telephony service providers which assign telephone numbers to subscribers or for successful completion of connection termination in case of direct connection to the requested number. The Company cannot be held responsible for the content of telephone conversations between the client and the called party by connection to the requested service, providing only technical means of connection.
8.4. In case in which the caller requests a certain phone number available in the database, the Company responds to this request but is not responsible for restrictions on calls to that number (e.g. calls restriction) that were agreed and implemented by the telecommunications provider at request and on behalf of subscriber.
8.5. The Company does not guarantee availability of services from public phones or pay phones / call centers with activated call restriction.

9. Clients’ liabilities

9.1. The client must observe the rules and conditions of use of the Service. Personal data of subscribers are supplied to the Client only within the information service regarding the subscribers.
9.2. The client hasn’t the right to create electronic or printed books using the data provided for marketing, advertising, etc. The client must comply with Romanian legislation on protection of personal data. Non-compliance leads to suspension or interruption of Services by the Company.

10. Data confidentiality

10.1. The Company assures the confidentiality of data provided by the Client, according to the law.
10.2. The Client agrees that discussions with the operator are monitored by other employees of the Company and eventually recorded to ensure quality control and improvement of provided services.
10.3. Client’s connection to the Service is made by accepting the using terms.
10.4. The Client agrees and acknowledges the fact that, for invoicing purposes, the Company may store and transfer relevant information to the phone operator to which is subscribed, such as:
a) caller ID (caller's number-CLID) from which calls to INFOCLICK SA network
b) elements defining the call duration (date, start time, end time).
10.5. The company created a special line, without extra charge to answer clients’ questions in respect to the Service. The Clients can contact the Company via phone: +40 215297109, e-mail: info@118800.ro. By the same number the client can confirm/modify personal information stored by the Company in computer system. In case in which the client wishes to be deleted from the database administered by the Company it must send a signed request to the company's headquarters. In case in which the Company receives the statement signed by the Client to delete information from the backup system, the Company reserves the right to keep Clients’ personal data for invoicing purposes, in accordance with relevant provisions of the legislation in force.
